LAST WILL AND TESTAMENT OF Stephen Farr, Deceased.
Be it remembered , that heretofore, to wit on the 23rd day of March in the year of our Lord one thousand eight hundred and seventy four, LAFAYETTE FARR of Clayton, Jefferson county, New York executor named in the last Will and Testament of STEPHEN FARR late of the town of Clayton in the county of Jefferson deceased, appeared in open court before the surrogate of the county of Jefferson and made application to have the said last Will and Testament, which relates to both real and personal estate, proved and on such application the said surrogate did ascertain by satisfactory evidence who were the heirs at law and next of kin of the said testator, and their respective residences, and they are as follows VIZ said petitioner LAFAYETTE FARR, CLARISSA CROSBY, & ALMA E. STEELE of Clayton Jefferson County N.Y. FRANCIS M. FARR of Potsdam St. Lawrence county, N.Y. ANNA H SHEPARD of Jordonville, Herkimer county, N.Y. SALLY RAPPOLE of Watertown, N.Y. EPHRIAM FARR of Cass City, Tuscola County, Michigan. STEPHEN FARR of Des Moines, Iowa, ELIAS FARR of Hartland, North county, Iowa, FOSTER FARR, New Hampton, Iowa NANCY BAKER AND DEXTER FARR of Timoha???Wisconsin children of said testator. FRANCIS FARR AND DEMPSTER FARR only children of DEMPSTER FARR, a deceased son of said testator minors under the age of 21 years and residing with their mother, FRANCES FARR in the city of Watertown, Jefferson Co., N.Y. PEARLY FARR , LYMAN FARR, ALDEBERT FARR, ELIZABETH FARR only children of JAMES FARR a deceased son of said testator all minors under 21 years of age and residing with their mother AMANDA FARR in the city of Watertown, Jefferson County, N. Y. MADISON MACOMBS AND CYNTHIA PATCHIN children of LUCINDA MACOMBS a deceased daughter of said testator . Madison residing at Lyme, Jefferson County, N.Y. and said Cynthia residing at St. Catherines laicada and FREEMAN FARR AND JOEL FARR children of testator if alive residing in Iowa where deponent does not know all of other persons are of full age except those who are mentioned and described above as minors--and said surrogate did thereupon issue a citation in due form of law, directed to the said heirs at law and next of kin of the said testator by their respective names stating their respective places of residence and requiring them to appear before said surrogate at his office in the city of Watertown in said county on the 12th day of May AD 1874 to attend the probate of said Will and afterwards to wit on the 12th day of May AD 1874 said matter was duly adjourned and held open to the 16th day of June 1874 on which day to wit June 16th, 1874 satisfactory evidence by affidavit was produced and presented to said surrogate of the due service of said citation in the mode prescribed by law on all those which the law was directed except the said DEMPSTER FARR and FRANCIS FARR and satisfactory evidence was also produced and presented to said surrogate showing the residence of the said FRANCIS FARR AND DEMPSTER FARR to be at Arerill Station Midland County Michigan with one JAMES N. OSBORN and thereupon said surrogate issued a new citation in due form of law denoted to the said DEMPSTER FARR AND FRANCIS FARR by their respective names holding their respective places of residence and requiring them to appear before said surrogate at his office in the city of Watertown in said county on the 25th July AD 1874 to attend the probate of said Will and therefore no one appearing in opposition thereto said surrogate duly adjourned said matter of the said 25th day of July AD 1874 and afterwards wired on the 25th day of July AD 1874 satisfactory evidence by affidavit was produced and presented to said surrogate of the due service of said citation in the words prescribed by law on the said DEMPSTER FARR, and FRANCIS FARR and thereupon said surrogate duly appointed ROSS C. SCOTT ?? of said city of Watertown special guardian of said infants DEMPSTER FARR, FRANCIS FARR, PEARLY FARR, IRMA FARR, ADELBERT FARR, & ELIZABETH FARR and of MADISON MACOMBS a person of unsound mind for the sole purpose of appearing for them and taking care of their interests in this matter said special guardian immediately appears in person afore said surrogate and thereupon satisfactory evidence was produced and presented to said surrogate hearing that GARDNER G. VINCENT one of the subscribing witnesses to said residing at Clayton in said County was sick & unable to attend before said surrogate and give evidence as said subscribing witness and thereupon said surrogate duly adjourns and held said matter over to the 27th day of July 1874 on which day with July 27, 1874 he went to Clayton aforesaid with residence of the said GARDNER G. VINCENT and with this evidence as one of the subscribing witnesses to said will and therefore upon his return this office in the said city of Watertown we duly adjourn and held said matter open no one appearing in opposition thereto, to the 21st day of August AD 1874 on which day went on the 21st day of August 1874 none appearing in opposition thereto said surrogate duly adjourned and held said matter open to the 25th day of August 1874, on which day the evidence of Samuel H. Hammond the other subscribing witness to said will was duly noted by said surrogate and no one appearing in opposition with probate of said will, our said special guardian being personally present and therefore upon this 25th day of August AD 1874 said surrogate duly adjudges the said Will to a valid Will
